RESPONSIBILITIES, TERMS & CONDITIONS.
Please read the following carefully. Do not make payments until you have read these Responsibilities, Terms & Conditions. Receipt of any payment indicates acknowledgment & acceptance of the terms stated below.
YOUR RESERVATION WILL BE CONSIDERED CONFIRMED WHEN CAMPUS VACATIONS EMAILS A CONFIRMATION RECEIPT TO YOU. YOU WILL RECEIVE THIS EMAIL WITHIN 1 BUSINESS DAY.
RESPONSIBILITY:
Booking a Trip with Campus Vacations Inc. involves an agreement between the signor of this Reservation Form (hereinafter the “Traveler”) and Campus Vacations Inc. (hereinafter CV). The responsibility of CV and/or its agents are limited. CV acts only as an agent for travelers in regard to travel. CV assumes no liability for injury, damage, loss, accident, delay or irregularity arising out of tour arrangements. Tour services including but not limited to transportation, lodging, activities and events are furnished by independent contractors (suppliers) and do not act for or on behalf of CV. CV endeavors to choose the most reputable supplier, but maintains no control over the personnel, equipment, operations or goods of the said supplier and cannot be held responsible for their act or omissions. The travel services are subject to conditions supposed by their supplier and their liability may be limited. Your purchase of travel involves an agreement between you and those who provide the services. You should verify such conditions directly with each carrier or supplier of services. Please ensure you understand their conditions prior to making a travel commitment. CV reserves the right to decline any traveler as a member of a tour at any time. The traveler agrees to comply with any reasonable instructions issued by CV relating to the tour. CV reserves the right to cancel or alter any travel services herein presented, at its discretion. In the event that an acceptable alternative cannot be found, CV’s only liability will be to refund all monies paid and it cannot assume responsibility or liability for any claims, loss or delay, disappointment, distress or frustration whether physical or mental resulting from any act or omission by CV, their employees, or any person collaborating with them. CV will not be held responsible for trip cancellations and delays both wholly and partially as a result of weather. You are encouraged to purchase travel insurance to protect yourself from such risks. You represent that you are not a minor, are at least the age of majority and have legal capacity to use this site and to create binding legal obligations for any liability you may incur.
DOCUMENTATION:
It is the Traveler’s responsibility to determine which documents are required for travel outside their country of origin. In the event that the Traveler does not obtain the required documents, the Traveler will be denied boarding by the carrier or refused entry into the country of destination. Entry to another country may be refused even if the required information and travel documents are complete. No refunds will be made should boarding or entry be denied because of insufficient or lost documents. In such an event, any cost associated with an early return home, or to the original departure point, will be the Traveler’s expense. Travelers traveling outside their country of origin who are under 18 years of age may require a notarized letter of permission to travel.
NOTICE TO TRAVELERS:
Travelers should be aware that different living standards and practices, and different standards and conditions with respect to the provision of utilities, services and accommodations might exist in countries outside of your own.
RESERVATIONS AND PAYMENTS:
An initial non-refundable deposit is required to confirm a reservation. Upon creating a group (cabin, unit, suite, or room), the individual registering the group will hereinto be referred to as the “Group Leader”. The Group Leader’s initial payment will be used as the non-refundable deposit. The remaining individuals that are assigned to the Group Leader’s unit as set out in the bookings page titled “Group Information” are responsible to pay the balance (or for trips that include a flight portion, the specified deposit which is also non refundable) in full within 14 days of creating the group. The Company has the right to cancel units/groups that are not paid for in full by the allotted 14-day deadline. Some lodging properties require a larger deposit during peak or holiday times. No lodging will be booked or confirmed without receipt of deposit. Upon receipt of deposit, a confirmation of receipt and final payment date will be sent to you. Any payments received within 30 days of departure will be considered late and will be assessed a $25 late fee. Any changes to a reservation once travel documents have been shipped will incur a $20 fee if new documents or vouchers need to be issued. CV cannot guarantee any reservations not paid on time. In some instances, CV is required to release rooms back to the supplier when not paid on time. In these instances, CV will make every effort to reacquire lodging space. The customer is required to pay any late booking fees or other expenses incurred by CV in this process. Should lodging space not be available, CV will make every effort to locate comparable lodging at the same resort or an alternate resort.
CANCELLATION POLICY:
CV must receive all cancellations in writing. For trips without a flight portion, cancellations received 30 or more days prior to departure will be assessed a per person penalty equal to the amount of 50% of their total cost. Cancellations received within 30 days of departure will receive no refund. For trips with a flight portion, cancellations received 90 or more days prior to departure will be assessed a per person penalty equal to the amount of 50% of their total cost. Cancellations received within 90 days prior to departure will receive no refund.
PRICES:
The prices advertised are based on fixed costs at the time of printing all marketing and advertising materials. These costs are dependent on fuel costs, rates of exchange and other factors. Should these costs increase, CV reserves the right to increase the price. If the total price of the travel services is increased and the cumulative increase, except any increase resulting from an increase in retail sales tax or federal goods and services tax is more than 7 percent the customer has the right to cancel the contract and obtain a full refund. Every effort will be made to advise you of any price increase at least 15 days prior to your Trip departure. Generally, Advertised prices are based on maximum occupancy in the lowest room category.
ROOM OCCUPANCY POLICY:
It is the responsibility of each traveler to fill his/her room to the specified occupancy. CV is not responsible for finding roommates. If a cancellation by one or more traveler changes the occupancy type and corresponding rate for the remaining travelers, those remaining travelers must pay an additional surcharge to cover the cost of the missing person. The price/occupancy and missing person surcharge varies on each trip. The exact occupancy and surcharge is specified on each trip description page and in the online booking steps for each trip.
NO REFUNDS FOR UNUSED SERVICES:
Refunds or allowances will not be made for transportation, accommodations, lift tickets, services or other portions of the tour that are unused on or after the tour departure date.
INSURANCE:
Travelers are strongly advised to protect themselves with insurance. Optional cancellation, accident, health and baggage insurance are available to protect tour participants from unforeseen circumstances. Upon request, CV will provide further information and rates. Insurance must be purchased no later than 30 days prior to trip departure or as required by the Insurance Company.
LODGING SECURITY DEPOSIT:
A security deposit is required by most properties upon check-in. The amount of deposit varies based upon the type of unit and the number of persons occupying the unit. The average security deposit is $100 cash per person per unit. The deposit is held to ensure that the rules and regulations of said property are adhered to. Failure to make a deposit will result in refusal of stay by the property owners. CV is not responsible for travelers that refuse to pay.
CHANGES IN ACCOMMODATION:
Every effort will be made to ensure that the accommodation included in the prices of the Trip will be provided as advertised. CV reserves the right to substitute accommodation for equal or better accommodations. Since CV does not control the management of hotels and resorts, CV cannot be responsible if some of the services described cease to be available or are not working.
CONSTRUCTION OR RENOVATION:
The Travelers acknowledges that the hotel or other accommodation selected and confirmed by CV for the trip maybe undergoing construction or renovations during The Travelers Trip. The Traveler agrees that he/she shall not be entitled to any refund or discount due to any such condition.
PRIVACY POLICY
CV respects the privacy of its travelers. CV collects personal information of its travelers only as necessary to provide services related to that specific traveler. CV must collect each traveler’s name and email address. The purpose of collecting this contact information is to notify trip participants of important trip details and announcements. CV may disclose its travelers’ contact information to other student promotional companies that may or may not be involved with CV. Any pictures, video or promotional footage taken by CV or other parties working with CV (which may include Travelers), during the Trip, will be the property of CV and can be used or disclosed and the Traveler consents to the use and disclosure for future promotional purposes. The Traveler also consents to the use and disclosure of any of the personal information collected regarding the Traveler (except for payment information) to enable CV or any of its promotional partners to inform the Travelers of events and promotions.
RELEASE AND INDEMNITY:
In consideration of CV’s acceptance of the Terms and Conditions for this Trip and any activity associated therewith, the Traveler releases and forever discharges CV, its officers, directors, employees, volunteers, successors, assigns, agents, and Suppliers from any and against all claims, costs, expenses and demands in respect to death, injury, loss or damage to his/her person or property wheresoever and howsoever caused, arising out of or in connection with the Trip or any activity associated there with notwithstanding that the same may have been contributed to or occasioned by an act or failure to act, including without limitation, negligence of CV and any one or more of its officers, directors, employees, volunteers, successors, assigns, agents, and Suppliers. And for the same consideration, the Traveler indemnifies and saves harmless CV, its officers, directors, employees, volunteers, successors, assigns, agents, and Suppliers from any and all claims, costs, expenses and demands in respect to death, injury, loss or damage to his/her person or property wheresoever and howsoever caused, arising out of or in connection with the Trip or any activity associated therewith. The Traveler further agrees that this release and indemnity shall bind his/her personal representatives, heirs, executors, administrators and assigns
GOVERNING LAWS:
This contract shall be interpreted in accordance with the laws of the Province of Ontario, Canada without regard to its law of conflict and provisions. You consent and submit to be exclusive jurisdiction of the provincial and federal courts located in the city of Toronto, the province of Ontario, Canada in all questions and controversies arising out of the contract. Any oral or written assurances or statements that differ from the terms of these conditions not expressly approved in writing by CV are not the responsibility of the CV. The conditions contained herein constitute the entire contract between CV and the traveler.
